By accessing or using DMS Resorts ("Company," "we," "our," or "us"), including our website, software, or services (collectively, "Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you must not use our Services.
2. Description of Services
DMS Resorts provides a platform that facilitates resort reservations, booking management, and related services ("Resort Services"). We act solely as a management tool and are not responsible for any issues arising from resort operations, service quality, or disputes between guests and resorts.
3. User Responsibilities
- a. You agree to provide accurate and complete information when using our Services. b. You are responsible for maintaining the confidentiality of your account credentials. c. You agree to comply with all applicable laws, regulations, and resort policies. d. You acknowledge that the actual resort administration, not DMS Resorts, is responsible for fulfilling reservations and services.
4. Payment and Fees
- a. Fees for bookings and services are set by the resort administration and processed through our platform, where applicable. b. Any disputes regarding payments, refunds, or cancellations must be resolved directly with the resort administration unless otherwise stated. c. DMS Resorts is not responsible for charge-backs, failed transactions, or unauthorized purchases.
5. Cancellation and Refund Policy
Cancellation and refund policies are set by the respective resort administrations. Users must review and comply with each resort’s policies before booking.
6. Disclaimers and Limitation of Liability
- a. No Warranty: Our Services are provided "as is" and "as available." We do not guarantee the accuracy, reliability, or availability of the Services. b. No Liability for Resort Issues: We are not responsible for the quality, safety, legality, or availability of resort accommodations and services. c. Software Use Risk: You use our software at your own risk. We disclaim all liability for any damages, including but not limited to lost reservations, technical failures, or data loss. d. Indemnification: You agree to indemnify and hold harmless DMS Resorts from any claims, damages, or disputes arising from your use of the Services.
7. Intellectual Property
- a. All content, trademarks, and software associated with our Services are owned by DMS Resorts or its licensors. b. You may not copy, modify, distribute, or exploit any part of the DMS Resorts without prior written consent.
8. Termination of Use
We reserve the right to suspend or terminate your access to DMS Resorts at any time, with or without cause.
9. Dispute Resolution
Any disputes arising from these Terms shall be governed by the laws of United States of America. Disputes will be resolved through arbitration or mediation before pursuing legal action.
10. Changes to Terms
We may modify these Terms at any time. Continued use of our Services after changes constitute acceptance of the revised Terms.
